What PPI Promised…

The basic idea behind payment protection insurance was that in the event you were unable to keep up repayments on your loan or credit card due to illness and not being able to work and so on, the PPI policy should kick in, and make the repayments for you.

But not all customers needed PPI. For example, some customers already had payment protection insurance policies in place, and didn't need another policy.

Some PPI policies were also limited in the cover, whilst others had a waiting time of three months or more before a claim could be made. All these limitations and instances of 'no cover' in the terms and conditions of PPI were not made obvious to the customer.

In some cases, some people were not asked or made aware that they had this type of payment protection insurance on their loan!

Payment protection insurance (PPI) and the saga around its mis-selling has held the British banking industry in its vice like grip since the mid-1990s when concerns about the product were first raised.

Compensation started to be paid at the very beginning of 2011 and continues to this day. But the days are numbered, with the Financial Conduct Authority consulting on a PPI June 2019 deadline.

This means that if you haven't yet made a claim for PPI compensation, and you don't before June 2019, it will be too late. And this means you could be waving goodbye to thousands of pounds - YOUR money.

Making a claim: what you need to know

To make a claim for PPI compensation, you need to do the following;

1. Find the paperwork or evidence you had PPI

PPI was added to all kinds of accounts that offered credit. Check accounts such as credit cards, car finance, mortgages, loans (personal and secured against property), store cards and some catalogue accounts also had PPI added to them.

You may find PPI as a separate policy or it may be included in the small print of the paperwork used to open your account.

Once you have located it, you have the evidence you need to approach the lender and ask for compensation.

2. Tell them why you were mis-sold PPI

PPI compensation claims have to follow the law as laid down in the Consumer Credit Act. And that means, as the customer, you need to tell the bank, lender or loan provider you were mis-sold PPI and the reasons why.

It may be, for example, you were unaware you had PPI and therefore, this constitutes mis-selling.

Or, you may have been led to believe that it was the right product for you and yet, you were unaware that your current medical condition or age disqualified you from making a claim.

Or, you may have felt at the time, that PPI and the loan you were applying for, for example, came as a package. Some people also felt that if they didn't take out PPI, they were less likely to secure the loan they needed.

3.   Wait for the bank or lender to respond

They should respond within eight weeks of receiving your letter. In straightforward claims, you can receive your PPI compensation within 12 weeks.

For more complex cases, it can take longer and it may also mean that if the bank or lender refuse your claim for PPI compensation, you can refer the matter to the Financial Ombudsman.

Can you Claim PPI compensation?

Mr. H was 66 years of age, newly retired after many years working for a public company. He and his wife wanted to sell their property and down size to a smaller place. In order to sell, they felt they needed to do some work on their home. Therefore, Mr H. applied for a personal loan to get the work done. His intention was to pay off the balance when the house was sold.

As part of the loan application, the bank representative suggested PPI would be a good policy as it would protect any repayments on the loan if Mr H. was unable to pay. As he was newly retired, he thought this was a good idea.

The bank representative also suggested it would stand his application in better light as it showed he was being responsible. As this was important to him and his wife, Mr H. signed on the dotted line.

On the face of it, the above scenario looks perfectly sensible and normal. The bank representative, said Mr H., took time to explain all about PPI and the loan he was applying for. It was an unsecured personal loan of £5,000 to make small changes to their current home, including decorating throughout the property.

There are however, several issues with Mr H. and the way he was sold PPI:

Age

It is clear that at no point did Mr H. withhold information. He had been a customer of this well-known high street bank for many years. However, PPI was only valid for people aged between 18 years and 65.

At 66, Mr H. would not have been covered by the PPI policy.

Retirement

Mr H. was also retired, a fact that he made clear when he told the bank why he wanted a small loan to complete improvements on their current home so that they could sell and down size. PPI was only for people who were in employment for more than 16 hours a week.

Mr H. was not in employment therefore he was not covered by the PPI policy.

A suggestion that buying PPI would stand his application in a better light

Mr H. was acutely aware that as he was retired with no independent income other than his state and personal pension that the bank may not see him his application in a favourable light. It was an emotional decision too as by completing the work on their current home, Mr & Mrs H. felt they would get a better price and sell quicker, something that was important to them as they wanted to move closer to their family who lived over 200 miles away.

The bank only consider applications based on credit score. Whether or not Mr H. bought a PPI policy or not should not have mattered to the success of his loan application. The bank representative was wrong to suggest this.
